The Mthatha-based Serious Commercial Crime Investigation team of the Hawks jointly with the National Prosecuting Authority (NPA) arrested Khayalethu Sakawuli (60) years at Mthatha on Friday, 25 August 2023 for allegations of theft of family Trust Funds.
It is alleged that the late father of the accused person bought properties at Cofimvaba to conduct a business and creation of a family Trust Fund.
Warrant Officer Ndiphiwe Mhlakuvana of the Hawks in Mthatha said the allegations are that the late father registered all his children as equal beneficiaries in the family Trust.
“The reports further revealed that all the children were beneficiaries in the trust. On 30 April 2021, it is alleged that the accused who is the eldest brother fraudulently removed his siblings from the trust through Makhanda Master’s court deliberately misleading the court claiming that the other beneficiaries wanted to be removed as signatories in the family trust”.
Mhlakuvana added that according to the reports, the siblings have never given the suspect any permission to be removed from the family trust.
The investigation exposed that the total amount of money that was misappropriated from the family trust was more than R2.8 million. The matter is remanded to 15 September 2023 for docket contents as well as to set a trial date.
