The Gauteng High Court in Pretoria on Tuesday reviewed and set aside findings made by advocate Terry Motau and Werksmans Attorneys against ANC Limpopo treasurer Danny Msiza.
Msiza who was penned as a mastermind in pushing the municipalities to invest in the VBS Mutual Bank.
The court agreed with Msiza and ruled that Motau’s failure to afford Msiza the right to procedural fairness before he released the report on VBS, was unlawful, unconstitutional and violated his constitutional rights.
In the VBS report, titled the Great Bank Heist, Msiza was painted as having huge influence in the money belonging to the municipalities to be saved in the bank. However, the court cleared him… for now.
On the judgment, he said he is humbled.
The South African Reserve Bank (SARB) which is the brain behind the report is ordered to pay the cost.
